1.1. These Terms and Conditions (hereinafter “T&Cs”) apply to all orders placed and contracts concluded via the online shop www.modern-natura.ch<\/a> (including associated domains, subdomains and mobile applications) between Modern Natura AG, St. Margrethen (SG) (hereinafter “Modern Natura AG” or “Seller”), and its customers (hereinafter “Customer”).<\/p>\n\n 1.2. A customer is any natural or legal person who maintains a business relationship with Modern Natura AG. Where individual provisions of these T expressly apply only to consumers (natural persons who enter into transactions for non-commercial or non-professional purposes), this will be stated separately. <\/p>\n\n 1.3. The offer is primarily aimed at customers with their place of residence or registered office in Switzerland and the Principality of Liechtenstein.<\/p>\n\n 1.4. Modern Natura AG reserves the right to reject orders in quantities that are not typical for household use, or orders where resale is suspected, without stating reasons.<\/p>\n\n 1.5. Modern Natura AG reserves the right to amend these T at any time. The version valid at the time of the order shall apply. Conflicting or deviating terms of the customer are not recognised unless Modern Natura AG expressly agrees to them in writing. <\/p>\n\n 2.1. Modern Natura AG’s website contains information about products and services. All information on the website (product descriptions, images, illustrations, videos, dimensions, weights, technical specifications, accessory relationships and other details) is for illustration purposes and should be understood as approximate values. It is non-binding and, in particular, does not constitute any assurance of characteristics or warranties unless expressly stated otherwise. <\/p>\n\n 2.2. Modern Natura AG strives to provide all information on the website accurately, completely and up to date. However, no warranty is given, either expressly or implicitly, for the accuracy, completeness or timeliness of the information. <\/p>\n\n 2.3. Product images may differ from the actual product in colour, texture and condition, especially for natural products. Such deviations do not constitute a defect. <\/p>\n\n 2.4. All information on availability and delivery times is without guarantee and may change at any time without notice. Modern Natura AG cannot guarantee that the listed products will be available at the time of ordering. <\/p>\n\n 2.5. Modern Natura AG accepts no liability for the continuous and uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content.<\/p>\n\n 3.1. The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue (invitation to make an offer, invitatio ad offerendum<\/em>).<\/p>\n\n 3.2. By clicking the “Order with obligation to pay” button (or a similarly clear wording), the customer submits a binding offer to purchase the goods in the shopping cart. Orders placed are binding for the customer. <\/p>\n\n 3.3. Confirmation of receipt of the order is sent immediately after submission via automated email (order receipt confirmation). This does not yet constitute acceptance of the offer. <\/p>\n\n 3.4. The purchase contract is concluded only when Modern Natura AG confirms dispatch of the goods by email (dispatch confirmation) or by actually delivering the goods.<\/p>\n\n 3.5. Orders are dispatched only after full payment has been received (exception: purchase on invoice) and provided the goods are available.<\/p>\n\n 3.6. If an ordered item cannot be delivered, or cannot be delivered in full, Modern Natura AG is entitled not to accept the order or to accept it only in part (partial delivery). Payments already made will be refunded in this case within 7 calendar days after notifying the customer. If no payment has yet been made, the customer is released from the obligation to pay. <\/p>\n\n 4.1. The sales prices stated on the website are final prices in Swiss francs (CHF) and include statutory VAT and any other statutory charges, such as advance recycling fees (ARF) or copyright levies, unless stated otherwise.<\/p>\n\n 4.2. Shipping costs are not included in the sales prices. They are shown separately during the ordering process and must be paid by the customer. <\/p>\n\n 4.3. Consulting and support services are also not included in the sales prices unless expressly agreed otherwise.<\/p>\n\n 4.4. Price changes, technical changes, errors and misprints are reserved. The price at the time of ordering applies. Modern Natura AG may make price changes at any time and without prior notice. <\/p>\n\n 5.1. The customer may use the payment methods shown during the ordering process. Modern Natura AG reserves the right, in individual cases and without stating reasons, to exclude certain payment methods or to require advance payment. <\/p>\n\n MF Group \/ POWERPAY offers the payment method “purchase on invoice” as an external payment service provider. With the individual invoice, the customer can pay for the online purchase by invoice. If the customer does not make payment within the specified timeframe, they will subsequently receive a monthly invoice in the following month with an overview of the order. <\/p>\n\n When the purchase contract is concluded, POWERPAY assumes the resulting invoice claim and handles the corresponding payment modalities. For purchase on invoice, the customer accepts, in addition to these TCs, POWERPAY’s TCs (available at powerpay.ch\/de\/agb<\/a>). <\/p>\n\n In the event of late payment, Modern Natura AG is entitled to send reminders by email and\/or letter post and to charge reasonable reminder fees. If no payment has been received even after the second reminder, Modern Natura AG reserves the right to instruct a debt collection agency to collect the outstanding amounts. All costs incurred in connection with reminders and debt collection (including default interest pursuant to Art. 104 CO) shall be borne by the customer. <\/p>\n\n The delivered goods remain the property of Modern Natura AG until all outstanding claims have been paid in full. The customer authorises Modern Natura AG to register the retention of title pursuant to Art. 715 SCC with the competent debt enforcement office. <\/p>\n\n 6.1. Delivery is made to the delivery address provided by the customer during the ordering process within Switzerland and the Principality of Liechtenstein. Deliveries abroad are only possible by separate agreement. <\/p>\n\n 6.2. Modern Natura AG strives to keep delivery times as short as possible. Any stated delivery times are non-binding guideline values unless a binding date has been expressly confirmed in writing. Delivery delays do not give rise to claims for damages or a right of withdrawal by the customer before expiry of a reasonable grace period set in writing. <\/p>\n\n 6.3. Modern Natura AG is entitled to make partial deliveries. In this case, shipping costs will be charged to the customer only once. <\/p>\n\n 6.4. If delivery cannot be made (for example, incorrect address, absence despite notification) or if the customer refuses to accept delivery without a lawful reason, Modern Natura AG may withdraw from the contract after notification by email and after observing a reasonable grace period of at least 10 calendar days. The costs for return shipment, storage and other expenses will be charged to the customer. <\/p>\n\n 6.5. Dispatch of the invoice (where purchase on invoice is offered) is at the discretion of Modern Natura AG by email or by post.<\/p>\n\n Benefit and risk pass to the customer upon handover of the goods to the transport company (post, freight forwarder or other person appointed to carry out the shipment). The customer must report transport damage to the delivery agent immediately and document the damage (for example with photos). <\/p>\n\n Modern Natura AG voluntarily grants the customer a right of withdrawal of 30 calendar days from receipt of the goods. No reason is required for withdrawal. To meet the deadline, it is sufficient to send the written withdrawal in due time by email or letter to the address stated in the imprint within the deadline. Exercising the right of withdrawal results in the contract being reversed. <\/p>\n\n The customer must return the goods within 14 calendar days after sending the withdrawal, in the original packaging, complete with all accessories and together with the delivery note, to the return address specified by Modern Natura AG (as per the imprint). Details can be found on the page Return and refund<\/a>. <\/p>\n\n The customer bears the costs and risk of the return shipment.<\/p>\n\n Any payment already made will be refunded to the customer within 7 calendar days after the returned goods have been received by Modern Natura AG. The refund is generally made using the same payment method the customer used for the order, unless expressly agreed otherwise. Modern Natura AG may refuse the refund until the goods have been returned or the customer has provided proof of shipment. <\/p>\n\n The right of withdrawal applies only to undamaged, unused and complete goods in the original packaging. In the event of damage, excessive wear or loss of value due to improper handling, Modern Natura AG reserves the right to deduct an appropriate reduction in value from the purchase price or to charge it to the customer. <\/p>\n\n The right of withdrawal is excluded in the following cases:<\/p>\n\n2.
